Can I Claim Social Security Disability for Cancer?

The Malignant Neoplastic Diseases section of the Social Security Administration's (SSA) impairment listing covers the majority of cancers with the exception of those associated with HIV infection. The SSA considers numerous factors when reviewing a cancer claim, but the primary criteria are still whether the individual has the residual functional capacity to work in a substantial gainful activity.

Exceptions may be made for certain types of cancer such as metastatic brain carcinoma, small cell lung cancer, inflammatory breast cancer, and cancer of the liver, pancreas, gall bladder, bile ducts or liver. In many cases, these claims are expedited, especially if the applicant's condition is very serious or the prognosis is terminal.

How Can a Lawyer Help?

Cancers that do not fall under one of the exceptions listed above may be eligible for Social Security Disability (SSD) benefits; however, there is extensive medical evidence required to prove your need for benefits.

In general, cancer claims must show the origin of the malignancy, extent of the involvement and the type of and response to treatments, including chemotherapy, radiation, surgery, hormones, immunotherapy and bone marrow or stem cell transplants. Our attorneys will gather the medical reports and other documents you need. We know what the SSA wants to see.

At Schwartzapfel Partners P.C., we understand that dealing with cancer is overwhelming. The last thing you and your family need is to spend days or weeks working on SSD paperwork.
