Will My Liver Transplant Be Covered Under Social Security Disability?
A diagnosis of end-stage liver disease (from cirrhosis/chronic liver disease) typically requires a transplant — removal of the nonfunctioning liver and transplantation of a whole or partial donated liver. The typical recovery period is six months to a year, during which the transplant recipient is not only physically weak but highly vulnerable to any infection.
If you or your loved one has had a liver transplant or expects to have one, the Social Security Administration (SSA) will recognize you as having a listed disability. However, approval for benefits is not quite automatic.
If you are able to convince the SSA that your liver transplant should be covered under Social Security Disability (SSD), you will be granted disability benefits for 12 months from the date of the transplant surgery. After one year, the SSA will decide whether you are still disabled based on residual impairments such as:
- Fatigue or weakness
- Infections
- Other medical conditions (kidney failure, ulcers)
- Organ rejection
- Neurological dysfunction (nerve damage, brain damage)
- Weight loss
To prepare for the 12-month review — or to dispute a finding that you are no longer disabled — our knowledgeable Social Security Disability lawyers assemble medical records and help document how these aftereffects of a liver transplant prevent you from returning to the workforce.
